Daniel Cherry Paine

February 21, 1831 - November 1861


 

Daniel Cherry Pain was born in Tennessee on February 21, 1831. His parents were Zachariah Paine and Nancy Turner Paine. According to court records in which Zachariah was released from a tax assessment the family settled in Colorado County, Texas in 1847. In August 1848 his brother, Don Fernando Payne, was approved as clerk of the district court. His father had a 750 acre plantation near Columbus, Texas which with 9 slaves produced fifity bales of cotton in 1850. His brother ,Don Fernando Payne, served as a delegate to the state temprance convention in 1853. According to Schedule 4 "Productions of Agriculture" on the 1860 Census Zachariah Payne owned a 1810 acre (210 acres improved) plantation near Praire Point, Texas. His holdings included 23 slaves, 10 horses, 6 asses and mules, 30 milk cows, 12 oxen, 160 other cattle, 100 sheep, 100 swine, 2500 bushels of corn, 91 bales of cotton, 200 bushels of sweet potatoes, and 1000 pounds of butter.

In August 1861 Daniel Pain along with Joseph H. Andrews, his friend and brother to two of his sisters in law, enlisted in a local militia unit, the Oakland Grays under Captain J. Duff Brown. On September 7, 1861 the two of them enlisted in Company F of Terry's Texas Rangers in Houston. Sometime between when the Rangers moved from Texas To Bowling Green , Kentucky he became ill and stayed at the home of his uncle, Greenwood Payne in Edgefield, Davidson County, TN where he died in November 1861. He was buried in the Payne Family Plot in Nashville, TN, November 14, 1861. and later reburied in Confederate Circle, Mt. Olivet Cemetery, Nashville, Tennessee. His friend Joseph Andrews was wounded at Shiloh and died before returning to Texas. His brothers, Don Fernando Payne and Josia F. Pain both sered in Company D of the 21st Texas Infantry.

In 1876 Belle Payne, grandaughter of his uncle Greenwood Paine, wrote a letter that was published in the Galveston Daily News in which she is attempting to locate his family members. She recalls that Daniel Payne was about six feet tall and wore a coonskin cap when he was at her grandfathers home in Tennessee.
